Terms & Conditions
Effective date: June 11, 2026
These terms govern your use of orkamarketing.com and any purchase of Orka Marketing ("Orka," "we," "us") services made through this site. Clients with a signed service agreement are governed by that agreement; where it conflicts with these terms, the signed agreement controls.
1. Services
Orka provides digital marketing services for local businesses, including the Local SEO Funnel package, paid advertising management, and related add-ons, as described on this site at the time of purchase.
2. Billing & term
- Local SEO Funnel (monthly): a one-time setup & build fee plus a recurring monthly fee, billed in advance. The initial term is six (6) months from the date of purchase, after which service continues month-to-month until cancelled with 30 days' written notice.
- Annual prepay: twelve (12) months of service billed once, with the setup fee waived. Renews annually unless cancelled before the renewal date.
- Ads management plans are quoted and agreed by separate service agreement following a consultation. Advertising budgets paid to Google, Meta, or other platforms are the client's own cost and are separate from Orka's fees.
- Late or failed payments may result in paused service after notice. Fees are exclusive of any applicable taxes.
3. Refunds & guarantees
- 7-day money-back guarantee: for purchases made through this site, you may cancel within seven (7) days of purchase for a full refund — email tyson@orkamarketing.com. After 7 days, the build is underway and the initial term applies.
- Top-3 Map Pack Guarantee: the Local SEO Funnel includes a performance guarantee defined in full at orkamarketing.com/guarantee-terms. Those terms control the guarantee.
- Except as stated above, fees are non-refundable.
4. Client responsibilities
You agree to provide timely access, information, and materials reasonably needed to deliver the services (e.g., onboarding details, Google Business Profile access, branding, photos), and to ensure information you provide about your business is accurate and lawful.
5. Ownership
Upon payment, deliverables created for you — your website, content, Google Business Profile, tracking phone number, and campaign data — are yours. If you leave, we transfer anything held in our accounts to you upon request. Orka retains ownership of its pre-existing tools, processes, templates, and know-how. We may reference work performed for you in our portfolio unless you ask us not to.
6. Acceptable use
You may not use this site or our services for anything unlawful, deceptive, or infringing, and you may not copy, scrape, or resell site content without permission.
7. Third-party platforms
Our services depend on third-party platforms (Google, Meta, and others) whose policies, rankings, and algorithms change without notice and are outside our control. Except where the Top-3 Guarantee expressly applies, we do not promise specific rankings, traffic, lead volumes, or revenue outcomes.
8. Disclaimers & limitation of liability
The site is provided "as is." To the maximum extent permitted by law: (a) Orka disclaims all implied warranties; and (b) Orka's total liability arising out of or relating to the services or this site is limited to the fees you paid to Orka in the three (3) months before the event giving rise to the claim. Orka is not liable for indirect, incidental, or consequential damages, including lost profits. Nothing in these terms limits liability that cannot be limited by law.
9. Governing law & disputes
These terms are governed by the laws of the State of Hawaii. The parties will first attempt in good faith to resolve any dispute informally; failing that, disputes will be resolved in the state or federal courts located in Hawaii, and each party consents to their jurisdiction.
10. Changes
We may update these terms; the version posted at the time of your purchase governs that purchase. Continued use of the site after changes constitutes acceptance for site use.
